Pet/Dog Boarding, Pet/Dog Daycare, Squad Fun Day and dog grooming Policies and Release of Liability.

 

THIS AGREEMENT is entered into by and between Anny Fischer/Pet Squad BXL, and Pet/dog owner.

1. Operation

​

• 1.1. Photo and video release: We love to post pictures and videos on Facebook, Instagram, Pinterest, our website, and/or in magazine ads. The owner agrees to allow Anny Fischer and Pet Squad BXL to use the owner’s pet’s name and any images or likeness of Owner’s pet taken while he/she is in our care, in any form, for use at any time, in any media, marketing, advertising, illustration, trade or promotional materials without compensation, and the owner releases to Anny Fischer and Pet Squad BXL all rights that the owner may possess or claim to such image, likeness, recording, etc.

• 1.2. Any new resident dog will only be accepted at the end of a trial boarding day which must be reserved at the regular boarding rate. To allow Anny Fischer and Pet Squad BXL team to test the dog, in particular as for his sociability with regard to his congeners and our members and for the dog to get familiarised with the environment.

​

• 1.3. Anny Fischer and Pet Squad BXL reserves the right to refuse an animal in the following cases, without this list being exhaustive: aggressive to human or other dogs, female in heat, seriously ill animal, potential flight risk, etc.

​

• 1.4. Anny Fischer and Pet Squad BXL accept the personal belongings of the animal but will decline all responsibility in the event of loss or deterioration of these during the stay.

​

• 1.5. In order to avoid as much as possible a digestive imbalance of the animal, the owner must bring his food for the entire duration of his stay.

​

• 1.6 The owner undertakes to respect the dates of the agreed stays.

​

• 1.7. In the event of a late request for an extension, Anny Ficher and Pet Squad BXL reserves the right to refuse it depending on its availability. However, any night reserved must in all cases be paid. In addition, in the event that  Anny Fischer and Pet Squad BXL has the possibility of welcoming the dog earlier than planned, the additional days will be billed at the usual rate. In the event of an extension, the owner undertakes to notify the guest house as soon as possible and, at the very least, before the return date originally scheduled, and to remunerate the Anny Fischer and Pet Squad BXL for the additional overnight stay (s).

• 1.8. The hours must be observed scrupulously, open on working days in the morning from 09 a.m. to 11 a.m. and in the evening from 5 p.m. to 7 p.m. Sundays and public holidays in the morning  from 11 a.m. to 12 p.m. and in the evening from 5 p.m. to 7 p.m. 

​

• 1.9. The animal can only be taken back by the person who left it, unless Anny Fischer and Pet Squad BXL has been notified in advance by the owner of the animal and provided with a picture of that person.

​

• 1.10. Any animal not taken back 7 days after the end of stay date provided for in the contract, and its owner having given no news, not being reachable, is considered abandoned. The animal will then be entrusted to an animal collection organization/Shelter.

​

• 1.11 In the event that the pet’s medicine, food or any other supplement is finished while in our care we could pick it up for an extra fee of 20 euros as long as the location is not more than 10 kilometers away from our location in Rue Vanderstraeten 41, 1080 Molenbeek.

2. Prices and payment

​

• 2.1. The price agreed includes accommodation and care provided by the pension.

​

• 2.2. The total amount or a deposit of 50% of the stay must be paid into Anny Fischer and Pet Squad BXL account to validate your reservation. The other 50% must be paid before the beginning of the stay. 

​

• 2.3. For all cases of cancellation or extension of stay, art. 1.6. of these general conditions is applicable.

​

• 2.4. For Dog Boarding we require a 7 days cancelation policy, meaning if you do not cancel your reservation 7 days before the starting date 50% of the total amount of the booking will be retained by Anny Fischer and Pet Squad BXL as compensation. For the rest of the services (Pet daycare and grooming) we require a 72-hour cancelation policy, or 50% of the total amount of the booking will be retained by the Anny Fischer and Pet Squad BXL as compensation. If your booking is made during the 7 days prior to the starting booking date, and you wish to cancel it also 50% of the total amount will be retained by Anny Fischer and Pet Squad BXL as compensation.

• 2.5. If the dog does not show up on the agreed dates and times, the stay will be canceled and the 50% of the total amount of the booking will be retained by Anny Fischer and Pet Squad BXL as compensation.

3. Animal health and welfare

​

• 3.1. The owner certifies that the animal is in good health and free from all parasites. He gives his dog's health record and passport to Anny Fischer and Pet Squad BXL upon admission, which must show that the dog has been vaccinated against distemper, hepatitis, parvovirus, leptospirosis and kennel cough.

​

• 3.2. He also undertakes to communicate to Anny Fischer and Pet Squad BXL any risks that his dog may present for himself or for his congeners such as, in particular, without this list being exhaustive: aggressive behavior, an allergy, an illness or another runaway or jumping behavior.

​

• 3.3. For its part, Anny Fischer and Pet Squad BXL undertakes to use all reasonable means to ensure the preservation of the well-being and health of the animal entrusted to it on the basis of the information provided to it. been communicated by the owner.

​

• 3.4. In the event of a health problem occurring during the duration of the stay, Anny Fischer and Pet Squad BXL undertake to contact as soon as possible the person mentioned in the contract as having to be contacted in the event of an emergency.

​

• 3.5. In the event that the person could not have been reached and that veterinary care is necessary, the master authorizes Anny Fischer and Pet Squad BXL to take all the necessary measures and undertakes to reimburse her for any costs hired for this purpose (veterinarian, pharmacist, etc.).

​

• 3.6. However, in the event that, despite all the measures taken, an accident or serious illness should result in injury or death of the animal, the responsibility of Anny Fischer and Pet Squad BXL could not be called into question, its obligation being an obligation to means and not of result.

​

• 3.7. Anny Fischer and Pet Squad BXL take all precautions to prevent an animal from running away. However, since zero risk does not exist, the owner will inform us of his dog's runaway behavior so that adequate measures can be taken. In the event that despite all the measures taken, a runaway should occur, the responsibility of Anny Fischer and Pet Squad BXL could not be called into question, its obligation being an obligation of means.

• 3.8. Owner understands and agrees that during normal dog play, Owner’s dog may sustain injuries. Dogs play is monitored by Anny Fischer and Pet Squad BXL staff to best avoid injury, but scratches, punctures, torn ligaments, and other injuries may occur despite the best supervision. Owner further understands and agrees that neither during daycare/boarding/grooming or any other offered service, Anny Fischer and Pet Squad BXL nor any of its employees, staff, or volunteers will be liable for any illness, injury, death, and/or escape of Owner’s dog(s) in our care provided that reasonable care and precautions are followed, and Owner hereby releases Anny Fischer and Pet Squad BXL staff or volunteers of any liability of any kind whatsoever arising from or as a result of Owner’s dog(s) during our care.

• 3.9. We do not require any dog to be altered, spayed, or stylised to be under our care, due to that, accidental pregnancy can occur even though we will take all the necessary precautions to avoid any accidental pregnancy to happen. The Owner hereby releases Anny Fischer and Pet Squad BXL staff or volunteers of any liability of any kind whatsoever arising from or as a result of the Owner’s dog(s) becoming pregnant during our care.

4. Civil liability

​

• 4.1. The owner will remain fully and exclusively responsible for any damage caused by his dog to one of his congeners to Anny Fischer, Pet Squad BXL staff, volunteers or to any third party during his stay.

​

• 4.2. The owner must be validly insured for civil liability for this type of damage during the stay.

​

• 4.3. Since Anny Fischer and Pet Squad BXL does not have the effect of transferring the risks which remain exclusively the responsibility of the owner, Anny Fischer and Pet Squad BXL will therefore not assume any responsibility for the damage referred to in art. 4.1. except in the event of fraud attributable to Anny Fischer and Pet Squad BXL or to one of its employees or volunteers.

5. Choice of court clause and applicable law

​

• 5.1. In the event of a dispute, only the courts of the district of Brussels will be competent (depending on the nature and the stake of the dispute).

​

• 5.2. They will apply Belgian law. The owner further understands and expressly agrees that each and every one of the foregoing provisions contained in this document shall be in force and effect and shall apply to each and every occasion on which the owner’s pet/dog(s) stays with Anny Fischer and Pet Squad BXL for daycare, boarding, Squad Fun Day, grooming or other services, as the case may be. This Agreement shall remain in full force and effect as between the parties until and unless otherwise canceled or superseded by a written signed by the parties.
